Karnataka: The Karnataka high court on Friday dismissed a PIL by the Association of Government Recognised Schools in Karnataka,with regard to seeking a proper procedure for announcing school holiday.
The petition asked for the holidays to be declared by the department of public instructions and not by the deputy commissioner. However, the court rejected the plea stating that was filed “just for publicity and not for gaining any useful purpose.”
A Division Bench comprising Chief Justice Subhro Kamal Mukherjee and Justice Malimath said that undeclared holidays are announced by the Deputy Commissioner of a district only in exigencies and with the intention of avoiding any untoward incident. This way, even the guardians would be happy and relaxed regarding the safety of their children.
Citing the recent events wherein holidays were declared at the last minute during the three days of transport bandh, the petitioner association had asked the court to issue a direction to the authorities to evolve a proper procedure under the Karnataka Education Act 1983 for declaring in advance holidays for schools/colleges in a given situation and not by DC’s of the concerned districts.
